Step 3 - Assignments between Treaty Countries
If you have determined that EC Regulation 883/2004 does not apply, your next step is to verify whether the employee's country of origin and country of work have signed a bilateral social security agreement (also known as a Totalization Agreement).
Social Security Agreements differ from one another
There is no standard Totalization Agreement; therefore, each one requires individual research:
Whom does it apply to (workers, family members, retired workers, etc.)?
Are there nationality and/or country of residence requirements?
To which territory does it apply?
To which insurance does it apply?
What is the main rule, and which exceptions are in place?
Is there a multi-state article?
Is there a consultation article?
What are the application requirements?
